When you access our website or use our services, you establish a relationship with us and become a part of The EMI Club family. These terms and conditions form a legal contract between you and The EMI Club.
The EMI Club ("TEC", "we", "our") is a brand owned and operated by Mash Technologies Pvt Ltd, which manages and provides the services available on this website and related digital platforms.
By using our site or products or services, you agree to be bound by these Terms and Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not use our site or services.
Disclaimer
- By agreeing to these terms, you confirm that you are at least the age of majority and legally entitled to enter into contracts.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of The EMI Club website/services without express written permission.
- You agree not to use our services for any illegal or unauthorized purpose or violate applicable laws while using our services.
- The EMI Club reserves the right to provide, continue, or discontinue any service, or any part thereof, without prior notice.
- We reserve the right to accept or reject service to anyone for any reason at any time.
A breach or violation of any of these Terms and Conditions will result in immediate termination of your services with The EMI Club.
1. General Conditions
Your willingness to avail our services constitutes your "offer" which shall be subject to these terms and conditions. We reserve the right to "accept" or "reject" your offer.
2. Loan Process Information
- Dealers associated with The EMI Club may share information of eligible and potential customers who are interested in availing loan services.
- Dealer-shared information may be used by The EMI Club to offer loan products and support completion of required formalities for financing mobile devices.
- Dealer-collected information may include self-attested KYC and other documents required to assess credit worthiness.
- Upon loan acceptance and execution of finance documents, such documents are handled per Digital Lending Guidelines and shared with customers.
- Customers are provided a Key Fact Statement (KFS) in prescribed format with APR, recovery mechanism, grievance details, cooling-off/look-up period, and all related charges.
3. Use of Services
- The EMI Club provides transparent loan processing support for mobile phones through website, app, and partner dealers.
- Your use of these services implies your agreement to these Terms and Conditions.
4. Required Consent (Customer)
4.1 Digital/Online KYC Consent
By clicking "I agree", you confirm that you have read policy documents and grant unconditional consent to undergo KYC verification, fetch online KYC records, and perform additional checks including credit bureau validations.
4.2 CKYC Explicit Consent
- You consent to download KYC records from CKYCR for identity and address verification.
- You understand that records may include name, address, DOB/incorporation date, PAN and related information.
- You agree personal KYC details may be shared with CKYCR or other competent authorities and that communication may be sent via SMS/email.
- You declare there is no change in existing details and CKYCR details are updated.
4.3 Bank Details Consent
You confirm that provided bank details for loan credit match existing KYC records provided to the lender.
4.4 CIC Reporting Consent
You acknowledge the lender's right to disclose relevant information, including loan details/defaults/security, to Credit Information Bureau of India and other regulatory/statutory agencies.
4.5 Correct Information Furnished
You declare information and documents furnished are true and correct to the best of your knowledge and belief.
4.6 Enquiry in Credit Bureau
You authorize the lender to make enquiries regarding your application, including with registered credit bureaus.
4.7 Accessing Mobile Resources
You provide consent for accessing required mobile resources such as files, media, contacts, camera, microphone, location, or other facilities necessary for loan processing.
4.8 Address Consent
You confirm your present address is also your permanent address and agree to notify the lender within two weeks of any address change with required documents.
5. User Comments, Feedback and Other Submissions
Reviews, comments, suggestions, feedback, and other submissions sent to us may be used by us without restriction, and such submissions remain our property.
We are under no obligation to:
- maintain comments in confidence,
- pay compensation for comments, or
- respond to comments.
You are solely responsible for comments posted by you and their accuracy. We may monitor, edit, or remove content that we determine to be unlawful, offensive, or in violation of rights/terms.
6. Intellectual Property Rights & Third Party Links
- Any use of this website, content, services, or products beyond personal non-commercial use is prohibited without explicit permission.
- All names, logos, marks, text, media, code, and related assets are owned by or licensed to The EMI Club and are protected by applicable laws.
- Third-party links are provided for convenience only and do not imply endorsement; use of third-party websites is at your own risk.
7. Limited Liability
- Services are provided "as is" and "as available" without express or implied warranties.
- We do not guarantee uninterrupted, timely, secure, or error-free service.
- In payment default cases, mobile restrictions may apply as per agreed terms.
- Total liability under these terms is limited to the amount charged against the value of products ordered.
8. Usage Restrictions
You are prohibited from using this website:
- for unlawful, immoral, obscene, abusive, defamatory, or discriminatory purposes;
- to violate intellectual property rights;
- to submit false/misleading information;
- to upload malicious code or interfere with service operations;
- to collect/track others' personal information;
- to spam, phish, crawl, scrape, or breach applicable laws.
Violation may result in termination of access to our services and platforms.
9. Force Majeure
The EMI Club is not liable for delay/failure in performance caused by force majeure events including natural calamities, pandemics, government orders, trade restrictions, or other causes beyond control.
In such events, performance obligations may stand extended for the affected period.
10. Indemnification
You agree to defend, indemnify, and hold harmless The EMI Club and its affiliates, founders, partners, licensors, suppliers, dealers, agents, employees, and service providers against claims/liabilities/losses arising from your use of services, breach of terms, legal violations, or misuse of data extraction tools.
This obligation survives expiry or termination of these terms.
11. Applicability of These Terms and Conditions
- These terms are complete and binding between you and The EMI Club for each service usage/purchase.
- Any new products/services/features/tools are also subject to these terms.
- We may update/replace terms without prior notice; continued usage implies acceptance.
- If any provision is unlawful/void/unenforceable, remaining provisions continue in full force.
12. Dispute Resolution
- Disputes shall be determined by arbitration in Mumbai, Maharashtra, under LegalRise Arbitration Rules.
- A sole arbitrator shall be appointed by the institution and proceedings shall be in English.
- Disputes are subject to institutional arbitration per Arbitration & Conciliation Act, 1996.
